HHS Rule Exempts Four Federal Systems From Privacy Act Provisions
Last week, HHS in the Federal Register published a final rule exempting four federal computer systems, or "systems of records," from several Privacy Act provisions, Health Data Management reports.
One of the exempted systems is the HIPAA information tracking system, called HITS, that is used to track alleged violations of HIPAA's administrative simplification provisions. According to the rule, HITS "consists of an electronic repository of information, documents and supplementary paper document files resulting from investigations of alleged violations of the transactions and code sets, security and unique identifier provisions of HIPAA."
The other computer systems exempted under the rule include the:
- Automated Survey Processing Environment Complaints/Incidents Tracking System, which covers complaints against health care facilities;
- Organ Procurement Organizations System, which covers complaints; and
- CMS Fraud Investigation Database (Health Data Management, 9/29).
